These terms are for hosts. A host invites other people to ScamReflex and looks after their practice. If you are here to practice yourself, the terms that apply to you are the ScamReflex terms.

Who we are

ScamReflex is a trading name of Roman Voloboev, operating as a self-employed person (autónomo) registered in Spain under identification number (NIE) Z2459759Y. When these terms say "we" or "us", they mean that business. You can reach us at [email protected].

What a host is

As a host, you invite people to ScamReflex, you hold the places you hand out, and you can see how the people you invited are getting on with their practice. That is the whole point of a host account: someone is looking after the practice of a group of people, and can tell how it is going.

Each person you invite has their own ScamReflex account and their own agreement with us. They can stop at any time, and we do not tell you why they stopped.

The people you invite

Invitations are for organizing a scam-awareness program. You do not have to know the people you invite personally. An organization often works with people it has never met, and that is a fair use of a host account.

When you give us someone’s email address, you are telling us three things, and we send on the strength of them:

• The address is one you are allowed to use for this. It came from the person themselves, or from your own organization’s records about them. It did not come from a list you bought, scraped, or were passed by someone else.
• The person is an adult. The people you invite must be adults. ScamReflex is a service for adults, and each one gives their own consent when they sign up.
• The person will not be surprised to hear from you. They know who you are.

If an invitation you sent leads to a complaint against us, or costs us a fine, a loss, or a claim from someone else, you agree to cover us for it. This is the one part of these terms where the cost falls on you, and it is here because we send on your word and have no way to check an address ourselves.

Your places

Every host account comes with a number of free places to hand out. How many depends on the kind of host account you chose. That number is shown to you when you sign up and inside your account, and it is the number in your account that counts, not a number written on this page.

An invitation you send holds a place until it is accepted or until it expires. When it expires, the place comes back to you.

If you need more places than your account comes with, extra places may be available for a fee. We will show you the price and what it includes before you agree to it, and we will never add a charge to your account without you agreeing to it first.

If we change how many free places a host account comes with, the change applies to new host accounts. We will tell you before anything changes for yours.

If you stop paying for extra places

You keep the free places your account comes with. The people already using ScamReflex through you keep their own accounts and carry on practicing, because each of them has their own agreement with us and it does not depend on yours.

What changes is on your side. Those places no longer count as yours, so you can no longer see how those members are getting on, and you cannot invite anyone new until you are back within your free places.

What the people you invite are told about you

Your name, and your organization name if you have one, together with your email address, appear in every invitation you send and on the Account page of each person who joined through you. They will know who invited them and how to reach you.

Your email address

The email address you sign up with is how you sign in, and it cannot be changed. If you lose access to that inbox, you lose the account and the connection to the people you invited with it. Please sign up with an address you expect to keep.

What we ask of you

Please use ScamReflex for what it is for, and do not try to break it, overload it, or reach parts of it that are not yours.

Practice scams you write

ScamReflex lets you write practice scams of your own. What you write is yours, and you are responsible for it.

• Do not use the name, logo, or look of a real company, bank, delivery service, or government office anywhere in the scenario. That includes who the message appears to come from. Invent a name instead.
• Do not build a scenario around a real event or a real situation in the life of someone you invited. A practice scam teaches a pattern; it is never about one person.
• Keep it to the pressure a real scam uses. No medical emergencies, no death, no grief.

By saving a practice scam you tell us that its content breaks no law and no other party's rights, including trademark and copyright. If a claim is brought against us because of something you wrote, you cover it: our costs, our legal fees, and anything we are ordered to pay.

We do not read what you write before it is shown. We may remove a practice scam, or close your account, at any time.

What you see about the people you invited

Being a host means you can see how the people you invited are getting on. That information is theirs, not yours. It is given to you so that you can help them, and for nothing else.

• Keep it to yourself, and to the people in your organization who need it in order to help. Do not publish it, sell it, or pass it on.
• Do not use it to decide anything about the person. If you are an employer, it plays no part in hiring, pay, promotion, discipline, or dismissal. If you run a program, a service, or a benefit, it plays no part in who gets in or who stays. ScamReflex measures practice, not people, and it is not fit to judge anyone by.
• If you stop using ScamReflex, this still holds for anything you learned while you were here.

If we find a host using what they see to penalize the people they invited, we will close the host account.

No guarantee, and limits on our responsibility

We work hard to make ScamReflex helpful and safe, but we provide it as it is. We do not promise that it will be free of every fault or that it will prevent every real scam.

As far as the law allows, we are not responsible for indirect or unexpected losses that follow from using ScamReflex. Nothing in these terms limits any right you have under the consumer law that applies to you, which continues to apply.

Changes to these terms

We may update these terms from time to time. The current version is always the one shown here, with the date it took effect at the top of the page. If we make an important change, we will let you know by email. If you keep using ScamReflex after a change, that means you accept the updated terms.

The law that applies, and how we sort out problems

These terms are governed by the law of Spain, where ScamReflex operates.

Wherever you live, you keep any rights the law of your own country gives you that cannot be signed away, and nothing here is meant to take those rights from you. If you live in the United States, that includes the protections of federal consumer law and of the law of your own state, which apply whatever this page says.

If something goes wrong, please write to us first at [email protected] and tell us what happened and what you would like us to do. Most problems are settled faster this way than any other, so please give us 30 days to put it right before taking it further.

If that does not settle it, a claim may be brought in the courts of Spain. If you are a consumer, you may instead bring it where you live, and nothing here stops you from using a small claims court.
